Preparing for a Disciplinary Hearing- Employee’s Perspective

Did you recently receive a Letter of Charge or Notice of Hearing from your employer by which you have been notified among other things of (i) alleged misconduct whether in relation to named policies, codes or other company documents; and (ii) a scheduled hearing that you are required attend? If so, here are a few tips for your protection:

  1. do you understand the nature of the charge (s) levied against you?
  2. were you provided with all the documents (whether mentioned in the Notice/Letter of Charge or otherwise) on which the Company intends to rely at the hearing?
  3. do you have a clear understanding of the relevant labour laws including the Labour Relations and Industrial Relations Act and the attendant Labour Relations Code, and how these rules may impact your hearing?
  4. do you know the names of the persons who will comprise the panel for the hearing and whether either or all of them were involved and/or connected to disciplinary process?
  5. were you advised of your right to have a representative of your choice present at the hearing?

The above are critical considerations to protect your interest in the process.
